{"id":232,"date":"2015-05-04T15:41:36","date_gmt":"2015-05-04T15:41:36","guid":{"rendered":"http:\/\/formaciocgt.net\/?p=232"},"modified":"2015-05-04T15:41:36","modified_gmt":"2015-05-04T15:41:36","slug":"materials-hores-sindicals-i-delegades-de-prevencio","status":"publish","type":"post","link":"https:\/\/formaciocgt.cat\/index.php\/2015\/05\/04\/materials-hores-sindicals-i-delegades-de-prevencio\/","title":{"rendered":"Materials: Hores sindicals i delegades de prevenci\u00f3"},"content":{"rendered":"<p>(En PDF: <a href=\"https:\/\/formaciocgt.cat\/wp-content\/uploads\/2015\/05\/diapos_horessindicals-dps_v2-1.pdf\" target=\"_blank\" rel=\"noopener\">Diapos_HoresSindicals<\/a> )<\/p>\n<p><strong>Regla General<\/strong><\/p>\n<p>El temps utilitzat pels Delegats de Prevenci\u00f3 per a l&#8217;exercici de les seves funcions\u00a0s&#8217;ha de carregar al cr\u00e8dit d&#8217;hores sindicals<br \/>\n<em>Art. 37.1 LPRL<\/em><\/p>\n<p><strong>Excepcions<\/strong><\/p>\n<p>El temps utilitzat per a les seg\u00fcents tasques es considera treball efectiu i NO es carrega al cr\u00e8dit d&#8217;hores sindicals:<\/p>\n<ul>\n<li>Reunions del Comit\u00e8 de Seguretat I Salut<\/li>\n<li>Qualsevol altra reuni\u00f3 convocada per l&#8217;empresari en mat\u00e8ria de PRL<\/li>\n<li>Acompanyament dels t\u00e8cnics en les avaluacions de car\u00e0cter preventiu del Medi Ambient de Treball<\/li>\n<li>Acompanyament dels Inspectors\/es de Treball en les visites al centre<\/li>\n<li>Visites dels DPs al lloc on s&#8217;ha produ\u00eft un accident de treball<\/li>\n<li>Formaci\u00f3 proporcionada per l&#8217;empresari als DPs<\/li>\n<\/ul>\n<p><em>Art. 37.1 i 37.2, en relaci\u00f3 al 36.2 a) i c) LPRL<\/em><\/p>\n<p><strong>Hores dedicades a tasques de representaci\u00f3 dels treballadors\/es FORA de l&#8217;horari de treball<\/strong><\/p>\n<p><em>STSJ BAL 246\/2013<br \/>\n(&#8230;) Concluimos, por tanto, que las horas que los representantes unitarios o sindicales dedican a su actividad representativa, para el caso de que se desarrollen fuera de su horario de trabajo, han de deducirse de las horas de trabajo efectivo asignadas al representante. (&#8230;)<\/em><\/p>\n<p><strong>PROBLEMA&#8230;<\/strong><\/p>\n<ul>\n<li>Els DPs normalment s\u00f3n tamb\u00e9 membres dels \u00d2rgans de Representaci\u00f3 dels Treballadors<\/li>\n<li>A m\u00e9s de les funcions de DP, han d&#8217;exercir tamb\u00e9 les funcions encomanades per l&#8217;Estatut dels Treballadors als Delegats de Personal o de Comit\u00e8s d&#8217;Empresa en mat\u00e8ria laboral<\/li>\n<li>La LPRL encomana moltes funcions als Delegats de Prevenci\u00f3<\/li>\n<li>La quantitat i complexitat dels temes que abarca la PRL, exigeix MOLTA dedicaci\u00f3<\/li>\n<\/ul>\n<p>NO HI HA TEMPS!!<\/p>\n<p>Interpretant la LPRL de forma \u00e0mplia, es pot entendre que els DPs que s\u00f3n tamb\u00e9 Delegats de Personal o de Comit\u00e8 d&#8217;Empresa tenen doble cr\u00e8dit d&#8217;hores sindicals:<\/p>\n<ul>\n<li>Un per a exercir de Delegat de Personal o de Comit\u00e8 d&#8217;Empresa<\/li>\n<li>Un altre per a exercir de Delegat de Prevenci\u00f3<\/li>\n<\/ul>\n<p>La ITSS i els Tribunals han desestimat sistem\u00e0ticament aquesta interpretaci\u00f3<\/p>\n<p>Podem sol\u00b7licitar el doble cr\u00e8dit a l&#8217;empresa, per\u00f2 no t\u00e9 sentit dedicar temps i esfor\u00e7 a presentar den\u00fancies si l&#8217;empresari ens ho denega&#8230;<\/p>\n<p><strong>FORMACI\u00d3 DELS DPs<\/strong><\/p>\n<p><em>Art. 37.2 LPRL<br \/>\nEl empresario deber\u00e1 proporcionar a los Delegados de Prevenci\u00f3n los medios y la formaci\u00f3n en materia preventiva que resulten necesarios para el ejercicio de sus funciones.<\/em><\/p>\n<p>La formaci\u00f3n se deber\u00e1 facilitar por el empresario por sus propios medios o mediante concierto con organismos o entidades especializadas en la materia y deber\u00e1 adaptarse a la evoluci\u00f3n de los riesgos y a la aparici\u00f3n de otros nuevos, repiti\u00e9ndose<br \/>\nperi\u00f3dicamente si fuera necesario.<\/p>\n<p>El tiempo dedicado a la formaci\u00f3n ser\u00e1 considerado como tiempo de trabajo a todos los efectos y su coste no podr\u00e1 recaer en ning\u00fan caso sobre los Delegados de Prevenci\u00f3n.<\/p>\n<p><strong>Qu\u00e8 s&#8217;ent\u00e9n per formaci\u00f3 necess\u00e0ria?<\/strong><\/p>\n<p>En general, la ITSS aplica el criteri de considerar suficient la Formaci\u00f3 de T\u00e8cnic de nivell B\u00e0sic en PRL<\/p>\n<p>Si volem sol\u00b7licitar formacions espec\u00edfiques sobre q\u00fcestions de PRL, \u00e9s bo fer-ho per escrit fent constar que les considerem necess\u00e0ries per a l&#8217;exercici de les nostres funcions com a DPs<\/p>\n<p><strong>Cursos de T\u00e8cnic B\u00e0sic en PRL<\/strong><\/p>\n<p>Durada m\u00ednima = 30h<br \/>\nSi l&#8217;empresa desenvolupa activitats de l&#8217;Annex I del RSP, Durada m\u00ednima = 50h<br \/>\n(Radiacions ionitzants, agents t\u00f2xics o molt t\u00f2xics, prod qu\u00edmics d&#8217;alt risc, agents biol\u00f2gics 3 i 4, mineria i sondejos, inmersi\u00f3, obres de construcci\u00f3, sider\u00fargia i construcci\u00f3 naval, producci\u00f3 gasos, pols silici, electricitat Alta Tensi\u00f3)<\/p>\n<ul>\n<li>Demanem que la formaci\u00f3 sigui presencial<\/li>\n<li>Millor si el curs l&#8217;imparteixen diversos formadors, experts en cada una de les especialitats<\/li>\n<li>Intentem rebre la formaci\u00f3 als CSSL o l&#8217;INSHT<\/li>\n<\/ul>\n<p><strong>Possibles formes d&#8217;afrontar la situaci\u00f3<\/strong><\/p>\n<ul>\n<li>La LPRL \u00e9s una llei de m\u00ednims i preveu que es millorin els m\u00ednims per la via de la negociaci\u00f3 col\u00b7lectiva<\/li>\n<li>Busquem sempre la interpretaci\u00f3 m\u00e9s favorable als treballadors i intentem anar m\u00e9s enll\u00e0 dels m\u00ednims legals<\/li>\n<li>Sol\u00b7licitem raonadament all\u00f2 que considerem convenient i forcem l&#8217;empresari a denegar-nos les nostres peticions<\/li>\n<li>Siguem conscients dels mitjans que tenim a l&#8217;hora de fixar-nos objectius<\/li>\n<\/ul>\n<p>La nostra feina \u00e9s una cursa de resist\u00e8ncia&#8230; NO ENS CREMEM!!<\/p>\n","protected":false},"excerpt":{"rendered":"<p>(En PDF: Diapos_HoresSindicals ) Regla General El temps utilitzat pels Delegats de Prevenci\u00f3 per a l&#8217;exercici de les seves funcions\u00a0s&#8217;ha de carregar al cr\u00e8dit d&#8217;hores sindicals Art. 37.1 LPRL Excepcions El temps utilitzat per a les seg\u00fcents tasques es considera treball efectiu i NO es carrega al cr\u00e8dit d&#8217;hores sindicals: [&hellip;]<\/p>\n","protected":false},"author":2,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[12],"tags":[],"class_list":["post-232","post","type-post","status-publish","format-standard","hentry","category-salut-laboral"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v25.0 -
